COBRA after medical termination of employment
Revised July 7, 2011
Our guest asks:
I have been out on disability leave and received state
disability income since February and if I do not
return to work by the end of may my medical benefits and
my employment will be terminated.
My Primary Care Provider does not feel I
will be able to return to work by May. I know I will
become eligible for COBRA benefits but will I be
eligible for the reduced rate if it is due to an
involuntary termination?
OnlineAdviser responds:
Yes, you would be eligible for COBRA coverage with the
premium subsidy upon termination of employment
regardless of whether your or the employer initiate the
termination. The only cause of termination of employment
that disrupts COBRA eligibility is a firing for gross
misconduct.
